Terms of Service

These Terms of Service, referred to as these Terms, govern your access to and use of the SnapCoach mobile application and website, together the Service, operated by Lu'dera Company Limited of Abuja, Federal Capital Territory, Nigeria, referred to as SnapCoach, we, us, or our. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility and age requirements

You must be at least 13 years old, or the minimum age required in your country to use an online service without parental consent, whichever is higher, to create a SnapCoach account. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate.

2. Your account

You are responsible for keeping your account credentials confidential and for all activity that takes place under your account. Please notify us immediately if you become aware of any unauthorized use of your account.

3. License to use the app

Subject to your compliance with these Terms, we grant you a limited, personal, nonexclusive, nontransferable license to download and use the SnapCoach app on a device you own or control, solely for your own personal, non-commercial use. This license does not give you any ownership interest in the app itself.

4. Your photos and the license you grant us

You retain full ownership of every photo you capture or upload through SnapCoach. By using our guided photo and enhancement features, you grant us a limited license to transmit and process those photos solely for the purpose of generating the preview or enhanced result you have requested, as described in our Privacy Policy. We do not use your photos for any other purpose, and as explained in our Privacy Policy, we do not retain a copy of them on our servers once that processing is complete.

5. Photos you upload

The Styles Upload feature lets you use any photo as the guide for your own shot, and Studio Edit lets you change a photo you choose. Only upload photos you took yourself or have permission to use. Photos of other people, or content owned by others, may be used for personal, non-commercial purposes only, and as the law allows. You are solely responsible for the photos you upload and for how you use the results, and you confirm that doing so does not infringe anyone else's rights.

7. Artificial intelligence generated content

Previews, enhancements, and Studio images produced by SnapCoach are generated using artificial intelligence and are provided as is. While SnapCoach is designed to preserve your genuine likeness, pose, and the real subject of your photo rather than inventing a new one, artificial intelligence output can occasionally be imperfect, unexpected, or not what you intended. Studio Create makes an entirely new image from your description, and Studio Edit changes the parts of a photo you ask it to, so neither should be presented as an unedited photograph. You are solely responsible for reviewing any generated image before sharing or relying on it, and for how you choose to use it. So that a paid session is not lost if it is interrupted, each generated preview or Studio image is held privately on our servers until it reaches your device, and for no more than 48 hours, as described in our Privacy Policy.

8. Free Guides, Credits, and subscriptions

SnapCoach provides a limited number of free guided sessions on a recurring basis, and offers additional usage through purchasable Credits and optional subscription plans that include perks and a bundled allowance of Credits. The amounts, refresh schedule, and pricing of Free Guides, Credits, and subscription plans are shown within the app and may change from time to time. We will take reasonable steps to communicate material changes in advance. Free Guides and any free trial are limited to one per person and one per device. To enforce this we check that requests come from a genuine copy of the app on a genuine device, and a device that has already received them for one account will not receive them again for another. Creating additional accounts to obtain more free usage is not permitted.

9. Free trial

Some subscription plans may begin with a free trial, as shown in the app before you subscribe. A free trial includes the limited number of Pro uses shown in the app and does not include bundled Credits, which are granted with your first paid billing period. Unless you cancel through your Apple or Google account settings before the trial ends, the subscription converts automatically into a paid subscription and you will be charged the price shown in the app at that time. Eligibility for a free trial is decided by Apple or Google and by us, and is limited to one free trial per person, per store account, and per device.

10. Billing, automatic renewal, and cancellation

All purchases are processed by the Apple App Store or Google Play, depending on your device, and are subject to their respective payment terms and refund policies. Subscriptions renew automatically at the end of each billing period unless you cancel through your Apple or Google account settings before the renewal date. Refunds are handled by Apple or Google in accordance with their own policies, and we are not able to issue refunds directly.

11. Third party services

The Service relies on certain third party providers to function, including infrastructure and hosting providers, an artificial intelligence image processing provider, and, where applicable, an advertising partner. Your use of those aspects of the Service is also subject to the terms and policies of the relevant provider.

12. Intellectual property

SnapCoach, its logo, and all related names, designs, and branding are the property of Lu'dera Company Limited. Other than the limited license granted in these Terms, nothing here transfers any intellectual property right in the app, its software, or its content to you.

13. Feedback

If you send us feedback, suggestions, or ideas about SnapCoach, you agree that we may use them freely, without any obligation to compensate you or keep them confidential.

14. Termination

You may stop using SnapCoach and delete your account at any time from Account and Security in the app. We may suspend or terminate your account if you violate these Terms, if we reasonably believe your account poses a risk to the Service or to other users, or as required by law. Sections of these Terms that by their nature should survive termination, including ownership, disclaimers, and limitation of liability, will continue to apply.

15. Disclaimer of warranties

The Service is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error free, or that any artificially generated result will meet your expectations.

16. Limitation of liability

To the fullest extent permitted by law, Lu'dera Company Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars if you have not made any payment. Nothing in these Terms limits any liability that cannot lawfully be limited, including liability for our own fraud or for death or personal injury caused by our negligence.

17. Indemnification

You agree to defend, indemnify, and hold harmless SnapCoach and its officers, employees, and agents from any claim, damage, or expense, including reasonable legal fees, arising from your misuse of the Service or your violation of these Terms.

18. Governing law and dispute resolution

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles, and the courts of the Federal Capital Territory, Abuja, Nigeria will have exclusive jurisdiction over any dispute that is not resolved informally. Before filing a claim, we encourage you to contact us so we can attempt to resolve the issue directly. If you are a consumer located in the European Union, the United Kingdom, Australia, or another jurisdiction whose law does not allow this choice of law and forum to override certain local consumer protections, this section does not remove any protection that law gives you, and you may also be entitled to bring a claim in the courts of your own country of residence.

19. Apple App Store terms

If you downloaded the app from the Apple App Store, the following additional terms apply, and take precedence over anything in these Terms that conflicts with them. These Terms are between you and SnapCoach only, not Apple, and Apple has no obligation to provide any maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. SnapCoach, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising from consumer protection or similar legislation. Apple is not responsible for investigating, defending, or resolving any claim that the app infringes a third party's intellectual property rights; SnapCoach is solely responsible for that. You represent that you are not located in a country subject to a United States government embargo and are not on any United States government list of prohibited or restricted parties. Apple and its subsidiaries are third party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third party beneficiary.

20. Google Play terms

If you downloaded the app from Google Play, your purchase and use of the app is also subject to the Google Play Terms of Service. Google is not responsible for the app or its content, and any questions, complaints, or claims relating to the app should be directed to us, not to Google.

21. Export control and sanctions compliance

You represent that you are not located in, or a national or resident of, any country subject to a comprehensive trade embargo, and that you are not identified on any government list of prohibited or restricted parties. You agree not to use the Service in violation of any applicable export control or sanctions law.

22. General provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapCoach regarding the Service. You may not assign these Terms without our consent; we may assign them freely in connection with a merger, acquisition, or sale of assets.

23. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will update the date above and, where appropriate, provide additional notice within the app. Your continued use of SnapCoach after a change takes effect means you accept the updated Terms.
